EXAMPLE

Basic Salary: AED 7,500

Years of Service: 5 years

Contract Type: Unlimited

  • Calculate Daily Wage.

Divide the monthly salary by 30  to get the daily wage. AED 7,500 / 30 = AED 250 per day.

  • Calculate Gratuity for the First 5 Years

For an unlimited contract, the gratuity is calculated as follows:

  1. 21 days salary per year for the first 5 years.

21 days * AED 250/day * 5 years = AED 26,250

  • Apply the Two-Year salary Cap

UAE labor law caps the gratuity at two years salary.

  1. 2 years * AED 7,500/month = AED 15,000

Since AED 26,250 exceeds the cap, the maximum gratuity payable is AED 15,000.

Popular Questions

Gratuity in the UAE is always calculated on the basic salary only. Allowances such as housing, travel, or overtime are not included in the calculation.

Private sector workers receive gratuity based on their years of service and basic salary. From 1–5 years it is 21 days per year, and after 5 years, it becomes 30 days per year.

For a limited contract, gratuity is usually paid if the contract is fully completed. For an unlimited contract, the amount depends on whether the worker resigned or was terminated.

Example: If your basic salary is AED 4,500 and you worked 3 years on a limited contract, gratuity =
(21 days × daily salary × 3 years).
Daily salary = 4,500 ÷ 30 = 150 AED →
Gratuity = 21 × 150 × 3 = AED 9,450.

The minimum service period is 1 year. Employees with less than one year of continuous service are not entitled to end-of-service gratuity.
