UAE Gratuity Calculations Rules

The UAE Labour Law defines specific calculation rules for gratuity based on contract type, service duration, and exit reason. Here’s how it’s calculated:

  • Limited Contract(1-5 Years): 21 day’s basic salary* number of years worked.
  • Limited Contract – Resigned: 30 day’s basic salary* number of years worked.
  • Unlimited Contract – Resigned:

     1-3 Years: 1/3 of Gratuity.

     3-5 years: 2/3 of Gratuity.

     5+ Years: Full Gratuity.

  • Unlimited Contract – Terminated: Full gratuity(same as limited contract).
  • Unpaid leaves are not included in total service duration.
  • Misconduct dismissal cancels gratuity benefits.

Who is Eligible for Gratuity in UAE?
