UAE Gratuity Calculations Rules
The UAE Labour Law defines specific calculation rules for gratuity based on contract type, service duration, and exit reason. Here’s how it’s calculated:
- Limited Contract(1-5 Years): 21 day’s basic salary* number of years worked.
- Limited Contract – Resigned: 30 day’s basic salary* number of years worked.
- Unlimited Contract – Resigned:
1-3 Years: 1/3 of Gratuity.
3-5 years: 2/3 of Gratuity.
5+ Years: Full Gratuity.
- Unlimited Contract – Terminated: Full gratuity(same as limited contract).
- Unpaid leaves are not included in total service duration.
- Misconduct dismissal cancels gratuity benefits.
Who is Eligible for Gratuity in UAE?
Full-Time Employees
Employees working under a full-time contract with at least 1 year of continuous service are eligible.
Minimum One Year
Gratuity is only paid if the employee has completed at least 12 months with the employers
Not Dismissed for Misconduct
Employees Terminated due to gross misconduct are not entitled to gratuity
